One of the most important points Attorney Nichani makes is this. Bankruptcy does not erase home equity. In a Chapter 7 or Chapter 13 filing, the debtor may still have significant equity in the home. That equity is real. That equity is recoverable. The key is understanding who controls the process and how a well-priced, well-presented home can still sell at or above market value even inside a bankruptcy proceeding.
In Silicon Valley, where home values rank among the highest in the nation, this distinction matters enormously. A Home Seller or successor trustee who does not understand the bankruptcy process may walk away from equity that was rightfully theirs to protect.

The Bankruptcy Trustee Controls the Sale
